Amazon held liable for defective products

In the US, Amazon was held liable by a court ruling under New Jersey law for defective products sold by third parties through its online marketplace. The case involved a hoverboard purchased from a seller in China that spontaneously caught fire while charging. Differences in state laws have led to conflicting rulings in similar cases in the US in recent years.

In Europe, TIE is calling for new product liability rules to hold online marketplaces liable in certain cases. A proposal to revise the EU Product Liability Directive is due in September 2022.
